Competent Persons Warranty

Contractors who carry out Electrical, Plumbing or ventilation works on a domestic dwelling from 1st April 2006 are obliged to comply with certain parts of the Building regulations and ensure that Local Authority Building Control is notified of any completed contract.

The Government has introduced 'Competent Persons Schemes'. Members must offer consumers, insurance protection against breech of those relevant Building Regulations, which will cover the works for a period of 6 years.

The principle of this type of insurance is to rectify defective workmanship or a breech of the Building Regulations where the contractor has ceased to trade through certain insolvancy procedures, death or retirement and is therefore unable to honor their obligations.

This insurance has been designed to offer consumers further piece of mind, this is with the knowledge that should a contractor that performed the notifiable works have ceased to trade for reasons detailed in their warranty document and is unable to remedy the defects found, the warranty will provide protection by meeting the reasonable cost of remedial works.

Guarantee of Standards Scheme

One of the conditions of enrolement with the NICEIC is that the standard of work of approved contractors must comply with British Standards 7671 - Requirements for Electrical Installations (IEE Wiring Regulations) and all other relevant British Standards and Industry Codes of Practice. In the event of work being found to be below the required standard, the defaulting contractor is required to undertake remedial work, at no extra cost to the consumer.

To protect both consumers and specifiers, the NICEIC Guarantee of Standards Scheme covers the possibility of an Approved contractor not honouring the requirement to undertake remedial work, in which case it will be undertaken by another approved contractor at no cost to the consumer.

Purpose of the scheme

To further the aims of the National Inspection Council in providing protection for electricity consumers, including the general public. To ensure that Local Government and other Authorities, Commercial organisations and Specifiers, using NICEIC Approved Contractors, are afforded protection with regard to the standard of electrical installation work contracted. To extend the scope of the NICEIC complaints procedure, where the Approved Contractor fails to undertake remedial work essential to safety. To enable Approved Contractors who tender for contracts to publicise the fact that they are not only approved by the NICEIC but that the standard of their electrical contracting work is guaranteed.
